U.S. makes final ruling on anti-circumvention of HFC refrigerants
On May 29, 2020, the U.S. Department of Commerce issued an announcement stating that it has made a definite final anti-circumvention ruling on hydrofluorocarbon blends imported from China, ruling that non-patent R-421A hydrofluorocarbon (HFC) imported from China ) The mixture is further processed in the United States to produce hydrofluorocarbon refrigerants (including R-404A, R-407A, R-407C, R-410A and R-507A) to circumvent current anti-dumping measures.
Based on the above affirmative final ruling, the US Department of Commerce will instruct the US Customs and Border Protection to continue to collect anti-dumping cash deposits for R-421A hydrofluorocarbon (HFC) mixtures imported from China. This tariff applies to all unliquidated goods since June 18, 2019 (the date the U.S. Department of Commerce initiated this evasion investigation). Depending on the exporter, the cash deposit is as high as 285.73%.
On July 16, 2015, the U.S. Department of Commerce announced an anti-dumping investigation on hydrocarbon mixtures and their components imported from China. The customs codes of the products involved were 3822.78.0000 and 2903.39.3030. On June 22, 2016, the U.S. Department of Commerce announced , To make anti-dumping and affirmative final rulings on changes in the situation of hydrocarbon mixtures and their components imported from China. On June 18, 2019, at the request of the American HFC Coalition, the U.S. Department of Commerce initiated an anti-circumvention investigation on HFC refrigerants imported from China.
